Magistrates' Court (Arbitration) (Professional Costs) Regulations 2009

The Lieutenant-Governor as the Governor's deputy with the advice of the Executive Council makes the following Regulations:

1Objective

The objective of these Regulations is to amend the Magistrates' Court (Arbitration) Regulations 2000 to increase the allowances for professional costs which may be awarded to a party in respect of an arbitration under Division 2 of Part 5 of the Magistrates' Court Act 1989.

2Authorising provision

These Regulations are made under section 140 of the Magistrates' Court Act 1989.

3Commencement

These Regulations come into operation on


1 May 2009.

4Amendments to Schedule 3

In clause 1 of Schedule 3 to the Magistrates' Court (Arbitration) Regulations 2000[1]—

(a)in paragraphs (a) and (c), for "$1114" substitute "$1203";

(b)in paragraphs (b) and (d), for "$1201" substitute "$1297";

(c)in paragraphs (e) and (f), for "$1288" substitute "$1391";

(d)in paragraph (g)—

(i)after "the Magistrates' Court Act 1989" insert "or a mediation under section 108 of the Magistrates' Court Act 1989";

(ii)in subparagraph (i), for "$209" substitute "$226";

(iii)in subparagraph (ii), for "$261" substitute "$282";

(iv)in subparagraph (iii), for "$314" substitute "$339".
