Sentencing Amendment Regulations 2009

The Governor in Council makes the following Regulations:

1Objective

The objective of these Regulations is to amend the Sentencing Regulations 2002 to—

(a)remove obsolete references in regulation 6; and

(b)prescribe persons or classes of persons for the purposes of sections 18VA(3)(b), 25(3)(b) and 46(3)(b) of the Sentencing Act 1991.

2Authorising provision

These Regulations are made under section 116 of the Sentencing Act 1991.

3Prescribed persons and classes of persons

(1)In Column 3 of the Table to regulation 6 of the Sentencing Regulations 2002[1] omit "Members of staff employed in CORE—the Public Correctional Enterprise in the Department of Justice—as Senior Prosecutions Officers." (wherever occurring).

(2)In the Table to regulation 6 of the Sentencing Regulations 2002, before the item relating to section 18W(1) insert

"18VA(3)(b) The Secretary to the Department of Justice. Members of staff employed in the Office of Public Prosecutions as legal practitioners or as legal executives.
Community corrections officers.".

(3)In the Table to regulation 6 of the Sentencing Regulations 2002, after the item relating to section 18W(1) insert

"25(3)(b) The Secretary to the Department of Justice. Members of staff employed in the Office of Public Prosecutions as legal practitioners or as legal executives.
Community corrections officers.".

(4)In the Table to regulation 6 of the Sentencing Regulations 2002, after the item relating to section 31(1A) insert

"46(3)(b) The Secretary to the Department of Justice. Members of staff employed in the Office of Public Prosecutions as legal practitioners or as legal executives.
Community corrections officers.".
