Magistrates' Court General Amendment Regulations 2009
The Governor in Council makes the following Regulations:

1Objective
The objective of these Regulations is to amend the form of search warrant in the Magistrates' Court General Regulations 2000 as a consequence of changes to the authority conferred by a search warrant under section 78 of the Magistrates' Court Act 1989.
2Authorising provision
These Regulations are made under section 140 of the Magistrates' Court Act 1989.
3Commencement
These Regulations come into operation on 3 September 2009.
4Principal Regulations
In these Regulations, the Magistrates' Court General Regulations 2000[1] are called the Principal Regulations.
5Schedule 5 amended
(1)In Form 15 of Schedule 5 to the Principal Regulations, for the following words and expressions—
"Place where search will be conducted for article, thing or material
Number and name of street
Suburb
"
substitute—
"*Place/*Vehicle located in a public place where search will be conducted for article, thing or material
*Number and name of street and suburb
*Identifying details of vehicle
".
(2)In Form 15 of Schedule 5 to the Principal Regulations, for the following words and expressions—
"to break, enter and search any place named or described in this warrant for any article, thing or material of any kind named or described in this warrant;"
substitute—
"to break, enter and search any *place/*specified vehicle located in a public place named or described in this warrant for any article, thing or material of any kind named or described in this warrant;".
(3)In Form 15 of Schedule 5 to the Principal Regulations, for the following words and expressions—
"Issued at am/pm on by Magistrate"
substitute—
"Issued at am/pm on by Magistrate
*Strike out whichever is not applicable".
