Road Safety Road Rules Amendment Rules 2009

The Lieutenant-Governor as the Governor's deputy with the advice of the Executive Council makes the following Rules:

1Objective

The objective of these Rules is to make minor miscellaneous amendments to the Road Safety Road Rules 2009.

2Authorising provision

These Rules are made under section 95D of the Road Safety Act 1986.

3Principal Rules

In these Rules the Road Safety Road Rules 2009[1] are called the Principal Rules.

4What is a roundabout

(1)In rule 109 of the Principal Rules for "A roundabout is an intersection with—" substitute "A roundabout is an intersection—".

(2)In rule 109(a) of the Principal Rules for "either—" substitute "with either—".

5Giving way by the rider of a bicycle or animal to a vehicle leaving a roundabout

In rule 119 of the Principal Rules omit ", motorised wheelchairs".

6Keeping off a painted island

In rule 138(1) of the Principal Rules for "under rule 139(4)" substitute "under this rule or rule 139(4)".

7Driving on or across a continuous white edge line

The penalty at the foot of rule 150(1B) of the Principal Rules is revoked.

8Proceeding when bicycle crossing lights change to yellow or red

The penalty at the foot of rule 262(2) of the Principal Rules is revoked.

9Use of mobile phones

At the foot of rule 300(1A) of the Principal Rules insert

"Penalty:10 penalty units.".

10Horse riding helmets to be worn by riders under 18

In rule 303A(1)(b) of the Principal Rules for "rider" substitute "rider or other person, as the case may be,".

11Exemption for drivers of police vehicles

In rule 305(1)(b) of the Principal Rules for "in the case of a police vehicle" substitute "if the vehicle is a motor vehicle".

12Obstructing roads

At the end of rule 401 of the Principal Rules insert

"(2)A person in a vehicle must not buy, or offer to buy, an article from a person standing on a road.

Penalty:2 penalty units.".
