Road Safety Act 1986

Road Safety (General) Amendment (Radar Device) Regulations 2009

The Governor in Council makes the following Regulations:

1Objective

The objective of these Regulations is to amend the Road Safety (General) Regulations 1999 to—

(a)provide for new speed measuring devices; and

(b)allow a parking infringement notice to be served on a person whose name and address have been supplied under section 84BE of the Road Safety Act 1986.

2Authorising provision

These Regulations are made under section 95 of the Road Safety Act 1986.

3Principal Regulations

In these Regulations the Road Safety (General) Regulations 1999[1] are called the Principal Regulations.

4Definition

In regulation 105 of the Principal Regulations, after paragraph (h) in the definition of radar device insert

"(i)the Falcon HR;

(j)the Raptor RP-1;".

5Use of radar devices

In regulation 310 of the Principal Regulations 1999—

(a)for paragraph (a) substitute

"(a)whenever the operator connects the radar device to a source of electricity, the operator ensures that—

(i)in the case of the Falcon HR and the Raptor RP-1, all  of the elements of the digital speed display are illuminated; and

(ii)in the case of any other radar device, a reading of (888) is displayed on the digital target speed display; and";

(b)in paragraph (c), for "and the Kustom Falcon," substitute ", Kustom Falcon and the Falcon HR,";

(c)in paragraph (d), for "and the Directional Golden Eagle II," substitute ", the Directional Golden Eagle II, and the Raptor RP-1,".

6Service of parking infringement notices

In regulation 501(1)(c) of the Principal Regulations, for "section 86(3)" substitute "section 84BE".
