Supreme Court (Criminal Procedure Further Amendment) Rules 2009

The Judges of the Supreme Court make the following Rules:

1Object

The object of these Rules is to make minor amendments to the Supreme Court (Criminal Procedure Amendment) Rules 2009.

2Authorising provisions

These Rules are made under section 25 of the Supreme Court Act 1986, the Criminal Procedure Act 2009 and all other enabling powers.

3Commencement

These Rules come into operation on 1 December 2009.

4Definitions

In Rule 12 of the Supreme Court (Criminal Procedure Amendment) Rules 2009[1], in proposed Rule 2.01(2), in the definition of respondent omit ", other than a Crown appeal".

5Noncompliance with Rule 2.10 or 2.11

In Rule 12 of the Supreme Court (Criminal Procedure Amendment) Rules 2009, in proposed Rule 2.13(1)(a), after "under" insert "Rule 2.10(1) or".

6Statute law revision

(1)In Rule 12 of the Supreme Court (Criminal Procedure Amendment) Rules 2009, in proposed Rule 2.45(3)(b)(iii), for "solicitors" substitute "legal practitioners".

(2)In Rule 13 of the Supreme Court (Criminal Procedure Amendment) Rules 2009, in proposed Rule 3A.08(1), for "Part" substitute "Order".
