Environment Protection (Scheduled Premises and Exemptions) Amendment Regulations 2009

The Governor in Council on the recommendation of the Authority makes the following Regulations:

1Objective

The objective of these Regulations is to amend the Environment Protection (Scheduled Premises and Exemptions) Regulations 2007—

(a)to provide for an exemption from provisions of the Environment Protection Act 1970 as a result of the Greenhouse Gas Geological Sequestration Act 2008; and

(b)to clarify existing exemption provisions in the Regulations; and

(c)to make consequential amendments as a result of the Environment Protection (Industrial Waste Resource) Regulations 2009.

2Authorising provision

These Regulations are made under section 71 of the Environment Protection Act 1970.

3Commencement

These Regulations come into operation on 1 December 2009.

4Principal Regulations

In these Regulations, the Environment Protection (Scheduled Premises and Exemptions) Regulations 2007[1] are called the Principal Regulations.

5Definitions

In regulation 5 of the Principal Regulations, in the definitions of contaminated soil and prescribed industrial waste, for "Environment Protection (Prescribed Waste) Regulations 1998" substitute "Environment Protection (Industrial Waste Resource) Regulations 2009".

6Amendment to Schedule 1

(1)In the Table in Schedule 1 to the Principal Regulations, in Column 2 of Type Number D08 (Edible Oil), for "200 tonnes" substitute "2000 tonnes".

(2)In the Table in Schedule 1 to the Principal Regulations, in Column 3 of Type Number K02 (Carbon geosequestration), for "No" substitute "Premises used only for greenhouse gas sequestration operations, as defined by the Greenhouse Gas Geological Sequestration Act 2008, and carried out in accordance with that Act, are exempt from works approval under section 19A and licensing under section 20(1) of the Act.".
