Major Crime (Investigative Powers) Amendment Regulations 2009
The Governor in Council makes the following Regulations:

1Objective
The objective of these Regulations is to amend the Major Crime (Investigative Powers) Regulations 2005 to be consistent with—
(a)the Criminal Procedure Act 2009; and
(b)recent amendments to the Major Crime (Investigative Powers) Act 2004.
2Authorising provision
These Regulations are made under section 70 of the Major Crime (Investigative Powers) Act 2004.
3Commencement
These Regulations come into operation on the day on which section 4 of the Major Crime Legislation Amendment Act 2009 comes into operation.
4Principal Regulations
In these Regulations, the Major Crime (Investigative Powers) Regulations 2005[1] are called the Principal Regulations.
5Taking of evidence
In regulation 8(d) of the Principal Regulations, for "appearing at" substitute "attending".
6Notice of application to Magistrates' Court to determine legal professional privilege
Regulation 9 of the Principal Regulations is revoked.
7Records to be kept by Chief Commissioner
In regulation 11(h) of the Principal Regulations—
(a)after "to the Supreme Court" insert "or to the County Court";
(b)after "by the Supreme Court" (where twice occurring) insert "or the County Court".
8Forms amended and revoked
(1)In Form 2 of the Schedule of the Principal Regulations, for "appear" substitute "attend".
(2)Form 7 of the Schedule of the Principal Regulations is revoked.
