Infringements (General) Further Amendment (Lodgeable Infringement Offences) Regulations 2009

1Objective

The objective of these Regulations is to amend the Infringements (General) Regulations 2006 to prescribe certain infringement offences under the Domestic Animals Act 1994, Electricity Safety Act1998, Environment Protection Act 1970, Fair Trading Act 1999, Road Safety Act 1986, Tobacco Act 1987 and the Transport Act 1983 as lodgeable infringement offences for the purposes of the Infringements Act 2006.

2Authorising provision

These Regulations are made under section 168 of the Infringements Act 2006.

3Commencement

These Regulations come into operation on 1 January 2010.

4Principal Regulations

In these Regulations, the Infringements (General) Regulations 2006[1] are called the Principal Regulations.

5Schedule 3 amended

(1)In the heading to item 1B of Schedule 3 to the Principal Regulations omit "(Feral and Nuisance)".

(2)In item 1B.2 of Schedule 3 to the Principal Regulations, for "29(3), 29(4)," substitute "29(5), 29(7),".

(3)After item 1B.3 of Schedule 3 to the Principal Regulations insert—

"1B.4Regulations 8(2), 9(2), 10(2), 16(1), 16(2), 17, 19(1), 20(1), 20(2), 21(1), 22(1), 22(2), 22(3), 22(4), 23(1) and 23(2) of the Domestic Animals Regulations 2005[2].".

(4)For item 9A.1 of Schedule 3 to the Principal Regulations substitute—

"9A.1Sections 7, 18, 18(1)(b), 19(8), 21(1A), 22(6), 49, 59(1)(a) and (3), 60, 60A, 65B, 168(1), 168(2), 174(1), 175(1), 184(2), 185(2), 185(3), 186(1) and 186(2).".

(5)For items 9A.2, 9A.3 and 9A.4 of Schedule 3 to the Principal Regulations substitute—

(7)After item 11.1 of Schedule 3 to the Principal Regulations insert—

6Schedule 4 amended

(1)For item 4.4 of Schedule 4 to the Principal Regulations substitute—

"4.4Regulations 13(1), 18(1), 18(2), 20(1) and 20(2) of the Electricity Safety (Cathodic Protection) Regulations 2009[7].".

(2)After item 4 of Schedule 4 to the Principal Regulations insert—

"4A Environment Protection Act 1970

4A.1Regulations 12, 27, 33(1), 33(2), 33(4), 34, 35 and 43(4) of the Environment Protection (Industrial Waste Resource) Regulations 2009[8].".

(3)For item 5.1 of Schedule 4 to the Principal Regulations substitute—
