Health Services (Private Hospitals and Day Procedure Centres) Amendment Regulations 2009
The Governor in Council makes the following Regulations:

1Objective
The objective of these Regulations is to—
(a)make consequential amendments to the Health Services (Private Hospitals and Day Procedure Centres) Regulations 2002 as a result of the commencement of the Assisted Reproductive Treatment Act 2008; and
(b)prescribe artificial insemination and assisted reproductive treatment as prescribed kinds of health services.
2Authorising provision
The Regulations are made under section 158 of the Health Services Act 1988.
3Commencement
These Regulations come into operation on 1 January 2010.
4Principal Regulations
In these Regulations, the Health Services (Private Hospitals and Day Procedure Centres) Regulations 2002[1] are called the Principal Regulations.
5Definitions
(1)In regulation 5 of the Principal Regulations the definition of infertility treatment is revoked.
(2)In regulation 5 of the Principal Regulations insert the following definitions—
"artificial insemination has the same meaning as in the Assisted Reproductive Treatment Act 2008;
assisted reproductive treatment has the same meaning as in the Assisted Reproductive Treatment Act 2008;".
6Private hospitals
For regulation 6(c) of the Principal Regulations substitute—
"(c)speciality health services for the provision of—
(i)artificial insemination; or
(ii)assisted reproductive treatment; or
(iii)cardiac services; or
(iv)emergency medicine; or
(v)endoscopy; or
(vi)intensive care; or
(vii)mental health services; or
(viii)neonatal services; or
(ix)obstetrics; or
(x)oncology (chemotherapy); or
(xi)oncology (radiation therapy); or
(xii)renal dialysis; or
(xiii)specialist rehabilitation services.".
7Day procedure centres
For regulation 7(c) of the Principal Regulations substitute—
"(c)speciality health services for the provision of—
(i)artificial insemination; or
(ii)assisted reproductive treatment; or
(iii)cardiac services; or
(iv)emergency medicine; or
(v)endoscopy; or
(vi)mental health services; or
(vii)obstetrics; or
(viii)oncology (chemotherapy); or
(ix)oncology (radiation therapy); or
(x)renal dialysis; or
(xi)specialist rehabilitation services.".
8References to fertilisation procedure
In regulation 49 of the Principal Regulations after "regulation 3(1)" insert "until 31 December 2009".
9Regulation 50 inserted
After regulation 49 of the Principal Regulations insert—
"50 References to infertility treatment
On and from 1 January 2010, a reference in a certificate of registration or a certificate of renewal of registration of a private hospital or day procedure centre to speciality health services for the provision of infertility treatment is to be read as a reference to speciality health services for the provision of artificial insemination or assisted reproductive treatment or both artificial insemination and assisted reproductive treatment as the case requires.".
10Schedule 3
(1)In Schedule 3 to the Principal Regulations in Section B in item 4 for "*Cardiac Services" substitute—
"*Artificial insemination
*Assisted reproductive treatment
*Cardiac Services".
(2)In Schedule 3 to the Principal Regulations in Section B in item 4 omit "*Infertility treatment".
