County Court Act 1958

County Court (Evidence Amendments) Rules 2009

A majority of the Judges of the County Court makes the following Rules:

PART 1—PRELIMINARY

1Object

The object of these Rules is to amend Chapter I and Chapter II of the Rules of the County Court as a consequence of the enactment of the Evidence Act 2008.

2Authorising provisions

These Rules are made under section 78 of the County Court Act 1958 and all other enabling powers.

3Commencement

These Rules come into operation on 1 January 2010.

PART 2—AMENDMENT OF CHAPTER I

4Affidavit in support

In Rule 22.03(2) of the County Court Civil Procedure Rules 2008[1] for "Evidence Act 1958" substitute "Evidence (Miscellaneous Provisions) Act 1958, the Evidence Act 2008".

5Nature of directions

In Rule 34.02(b) of the County Court Civil Procedure Rules 2008 omit "under section 55(7) of the Evidence Act 1958 or".

6Taking of depositions

In Rule 41.07(1)(c) of the County Court Civil Procedure Rules 2008 for "Part VI of the Evidence Act 1958" substitute "Part VI of the Evidence (Miscellaneous Provisions) Act 1958".

7Order 41A amended

(1)In the heading to Order 41A of t he County Court Civil Procedure Rules 2008 after "EVIDENCE" insert "(MISCELLANEOUS PROVISIONS)".

(2)In Rule 41A.01 of t he County Court Civil Procedure Rules 2008 after "Evidence" insert "(Miscellaneous Provisions)".

(3)In Rule 41A.06 of the County Court Civil Procedure Rules 2008 for "the Act" substitute "the Evidence (Miscellaneous Provisions) Act 1958".

8Form 41AA

In the heading to Form 41AA of the County Court Civil Procedure Rules 2008, after "EVIDENCE" insert "(MISCELLANEOUS PROVISIONS)".

9Order 11A amended

(1)In the heading to Order 11A of t he County Court Miscellaneous Rules 2009[2] after "EVIDENCE" insert "(MISCELLANEOUS PROVISIONS)".

(2)In Rule 11A.01 of t he County Court Miscellaneous Rules 2009 after "Evidence" (where twice occurring) insert "(Miscellaneous Provisions)".

In the County Court Miscellaneous Rules 2009—

(a)in Form 2–11AA, after "EVIDENCE" insert "(MISCELLANEOUS PROVISIONS)";
