Public Transport Competition Amendment Regulations 2010

The Governor in Council makes the following Regulations:

1Objective

The objective of these Regulations is to amend the Public Transport Competition Regulations 1999 to prescribe the formula used to calculate the annual accreditation fee for a courtesy service, a hire and drive service or a private bus service.

2Authorising provision

These Regulations are made under section 38 of the Public Transport Competition Act1995.

3Commencement

These Regulations come into operation on 1 February 2010.

4Fees (Clause 2(1) in Schedule 1)

For clause 2(1) in Schedule 1 to the Public Transport Competition Regulations 1999[1], substitute—

"(1)The annual accreditation fee for a—

(a)courtesy service; or

(b)hire and drive service; or

(c)private bus service—

is calculated in accordance with the following formula—

where—

Bis the number of buses proposed to be operated by the service in the period to which the fee relates; and

Mis the total number of calendar months for the period commencing on the date the fee is due and ending on 31 December 2010, including the month in which the fee is due.".
