Magistrates' Court Act 1989
Magistrates' Court (Judicial Registrars) Amendment Rules 2010
The Chief Magistrate together with 2 Deputy Chief Magistrates jointly make the following Rules:
1Object
The object of these Rules is to amend the Magistrates' Court (Judicial Registrars) Rules 2005 as a consequence of the commencement of the Criminal Procedure Act 2009.
2Authorising provisions
These Rules are made under section 16 of the Magistrates' Court Act 1989 and all other enabling powers.
3Commencement
These Rules come into operation on 3 February 2010.
4Proceedings that may be dealt with by a judicial registrar
(1)In rule 4(1) of the Magistrates' Court (Judicial Registrars) Rules 2005[1]—
(a)in paragraph (cb), omit "95,";
(b)after "1989" insert "and section 94(1) of the Criminal Procedure Act 2009".
(2)In rule 4(1A) of the Magistrates' Court (Judicial Registrars) Rules 2005, for "or section 95 or" substitute ", section 94(1) of the Criminal Procedure Act 2009 or section".
(3)In rule 4(3) of the Magistrates' Court (Judicial Registrars) Rules 2005, for "128A of the Magistrates' Court Act 1989" substitute
"59 of the Criminal Procedure Act 2009".
