Conveyancers (Professional Conduct and Trust Account and General) Amendment Regulations 2010

The Lieutenant-Governor as the Governor's deputy with the advice of the Executive Council makes the following Regulations:

1Objectives

The objectives of these Regulations are to amend the Conveyancers (Professional Conduct and Trust Account and General) Regulations 2008—

(a)to replace references to the Consumer Credit (Victoria) Code; and

(b)to amend the particulars that must be recorded in the trust account cash receipts book of a licensed conveyancer.

2Authorising provision

These Regulations are made under section 188 of the Conveyancers Act 2006.

3Commencement

These Regulations come into operation on 1 July 2010.

4Principal Regulations

In these Regulations, the Conveyancers (Professional Conduct and Trust Account and General) Regulations 2008[1] are called the Principal Regulations.

5Trust account receipts cash book

In regulation 17(1) of the Principal Regulations—

(a)for paragraph (h) substitute

"(h)details clearly identifying the ledger account to be credited.";

(b)paragraph (i) is revoked.

6Schedule 1 amended

(1)In Schedule 1 to the Principal Regulations, in rule 20(2)(d) and (4)(f), for "Consumer Credit (Victoria) Code" substitute "National Credit Code".

(2)In Schedule 1 to the Principal Regulations, after rule 20(6) insert

"(7)In this rule, National Credit Code has the same meaning as in the National Consumer Credit Protection Act 2009 of the Commonwealth.".
