Road Safety (General) Amendment (Application of Fees) Regulations 2010

The Lieutenant-Governor as the Governor's deputy with the advice of the Executive Council makes the following Regulations:

1Objective

The objective of these Regulations is to amend the Road Safety (General) Regulations 2009 to provide for certain fees received by the Corporation to be paid by the Corporation into its general fund.

2Authorising provisions

These Regulations are made under sections 95 and 97 of the Road Safety Act 1986.

3Commencement

These Regulations come into operation on 1 July 2010.

4Objective amended

After regulation 1(f) of the Road Safety (General) Regulations 2009[1] insert

"(fa)to provide that certain fees received by the Corporation are to be paid by the Corporation into its general fund; and".

5New Part 11A inserted

After Part 11 of the Road Safety (General) Regulations 2009 insert

"PART 11A—APPLICATION OF FEES

85AApplication of certain fees

The following fees received by the Corporation must be paid by it into its general fund—

(a)fees payable under regulation 701 of the Road Management (General) Regulations 2005 (property enquiry fees); and

(b)fees payable under regulation 18 of the Road Management (Works and Infrastructure) Regulations 2005 (consent fees for proposed works).
