Accident Compensation Amendment Regulations 2010

The Governor in Council makes the following Regulations:

1Objectives

The objectives of these Regulations are to amend the Accident Compensation Regulations 2001—

(a)to make a change to the prescribed number of hours that workers with multiple employers work under one employer in order to calculate their pre-injury average weekly earnings; and

(b)as a consequence of the commencement of certain provisions of the Accident Compensation Amendment Act 2010 on 1 July 2010; and

(c)to clarify the operation of regulation 18 of those Regulations.

2Authorising provision

These Regulations are made under section 253 of the Accident Compensation Act 1985.

3Commencement

These Regulations come into operation on 1 July 2010.

4Principal Regulations

In these Regulations, the Accident Compensation Regulations 2001[1] are called the Principal Regulations.

5Pre-injury average weekly earnings of workers with multiple employers

In regulation 10 of the Principal Regulations, for "35" substitute "38".

6Revocation of prescribed rates for travel and accommodation allowances

Regulations 11 and 12 of the Principal Regulations are revoked.

7Prescribed forms—contracts in respect of common law liabilities

In regulation 18 of the Principal Regulations, after "1985" insert "as in force before the commencement of section 35(3) of the Accident Compensation Legislation (Amendment) Act 2004".

8Revocation of certain self-insurer regulations

Regulations 19, 20, 21, 22, 23(3), 23(4), 23(5), Schedule 4 and Form 4 to Schedule 5 of the Principal Regulations are revoked.

9Contribution by self-insurers

In regulation 23(1) of the Principal Regulations, for "33A" substitute "146(2)".
