Prostitution Control (Fees) and Prostitution Control Amendment Regulations 2010
The Governor in Council makes the following Regulations:

PART 1—PRELIMINARY
1Objective
The objective of these Regulations is to amend the Prostitution Control (Fees) Regulations 2004 and the Prostitution Control Regulations 2006 to change their titles and update terms used in them, consequential upon the change of title of the Prostitution Control Act 1994 to the Sex Work Act 1994 made by the Consumer Affairs Legislation Amendment Act 2010.
2Authorising provisions
These Regulations are made under sections 3, 18, 68 and 90 of the Prostitution Control Act 1994.
3Commencement
These Regulations come into operation on the day that section 42 of the Consumer Affairs Legislation Amendment Act 2010 comes into operation.

4Change of title of regulations
For the title to the Prostitution Control (Fees) Regulations 2004[1] substitute—
"Sex Work (Fees) Regulations 2004".
5Change of terms
(1)In regulations 1 and 2 of the Prostitution Control (Fees) Regulations 2004, for "Prostitution Control Act 1994" substitute "Sex Work Act 1994".
(2)In regulation 4 of the Prostitution Control (Fees) Regulations 2004, in the definition of the Act, for "Prostitution Control Act 1994" substitute "Sex Work Act 1994".
(3)In regulation 5 of the Prostitution Control (Fees) Regulations 2004, for "prostitution" substitute "sex work".
(4)In regulation 6 of the Prostitution Control (Fees) Regulations 2004, for "prostitution" (wherever occurring) substitute "sex work".

For the title to the Prostitution Control Regulations 2006[2] substitute—
"Sex Work Regulations 2006".
7Change of terms
(1)In regulation 1 of the Prostitution Control Regulations 2006—
(a)for "Prostitution Control Act 1994" substitute "Sex Work Act 1994";
(b)in paragraphs (b) and (d), for "prostitution" (wherever occurring) substitute "sex work".
(2)In regulation 2 of the Prostitution Control Regulations 2006, for "Prostitution Control Act 1994" substitute "Sex Work Act 1994".
(3)In regulation 5 of the Prostitution Control Regulations 2006—
(a)in the definition of licensee, for "prostitution" substitute "sex work";
(b)in the definition of the Act, for "Prostitution Control Act 1994" substitute "Sex Work Act 1994".
(4)In regulation 7 of the Prostitution Control Regulations 2006—
(a)for "prostitute" (wherever occurring) substitute "sex worker";

8New regulation 9A inserted
After regulation 9 of the Prostitution Control Regulations 2006 insert—
'9A Transitional—advertising controls
Despite the amendment of regulation 9(1) by regulation 7(6)(b) of the Prostitution Control (Fees) and Prostitution Control Amendment Regulations 2010, for the purposes of regulation 9 an advertisement for a business that is carried on by a sex work service provider may contain either the letters "PCA" or the letters "SWA" for a period of 12 months from the commencement of those Regulations.'.
