Road Safety (General) Further Amendment Regulations 2010

The Governor in Council makes the following Regulations:

1Objectives

The objectives of these Regulations are to amend the Road Safety (General) Regulations 2009 to—

(a)prescribe certain road safety cameras; and

(b)prescribe matters to be included in traffic infringement notices relating to alleged drug‑driving infringements; and

(c)modify a prescribed infringement offence relating to unlicensed driving; and

(d)make minor statute law revision amendments.

2Authorising provision

These Regulations are made under section 95 of the Road Safety Act 1986.

3Commencement

(1)These Regulations, except regulation 6, come into operation on the day on which they are made.

(2)Regulation 6 comes into operation on 12 December 2010.

4Principal Regulations

In these Regulations, the Road Safety (General) Regulations 2009[1] are called the Principal Regulations.

5Prescribed road safety cameras

For regulation 30(q) of the Principal Regulations substitute

"(q)the camera system known as the REDFLEXred-speed HDX Optical system; and

(r)the camera system known as the PoliScan Speed; and

(s)the camera system known as the PoliScan Speed Mobile.".

6Prescribed details of traffic infringement notice

In regulation 75(1)(d) of the Principal Regulations, after "conviction" insert "and will result in suspension of the licence or permit of the person on whom it is served".

7Schedule 7—Traffic Infringements

(1)In Schedule 7 to the Principal Regulations, for "TA means the Transport Act 1983." substitute

"TCMA means the Transport (Compliance and Miscellaneous) Act 1983.".

(2)For item 107 of Schedule 7 to the Principal Regulations substitute

Unlicensed driving by the holder of a licence or permit issued outside Victoria whose 3 month exemption under RS(D)R 18(1)(a), or 6 month exemption under RS(D)R 18(1)(b), from holding a Victorian licence or permit has expired

2×5 penalty units".

(3)In column 4 of item 110 of Schedule 7 to the Principal Regulations for "RSA 59(1)(a) and (3), TA 216(1)(a)" substitute "RSA 59(1)(a) and (2), TCMA 216(1)(a) and (2)".

(4)Item 301 of Schedule 7 to the Principal Regulations is revoked.
