Magistrates' Court Criminal Procedure (Amendment No. 1) Rules 2011

The Chief Magistrate together with 2 Deputy Chief Magistrates jointly make the following Rules:

1Object

The object of these Rules is to provide that inspectors appointed under the Legal Profession Act 2004 are authorised in accordance with clause 30 of Schedule 3 of the Criminal Procedure Act 2009 to witness statements in a preliminary brief, full brief or hand-up brief.

2Authorising provisions

These Rules are made under section 16 of the Magistrates' Court Act 1989, section 419 of the Criminal Procedure Act 2009 and all other enabling powers.

3Commencement

These Rules come into operation on 22 April 2011.

4Prescribed member of a class of persons who may witness statements

In Rule 86 of the Magistrates' Court Criminal Procedure Rules 2009[1]—

(a)in paragraph (c) for "function." substitute "function;";

(b)after paragraph (c) insert

"(d)an inspector appointed under the Legal Profession Act 2004.".
