Owners Corporations Amendment (Infringements) Regulations 2011

The Governor in Council makes the following Regulations:

1Objective

The objective of these Regulations is to amend the Owners Corporations Regulations 2007 to prescribe infringement offences and penalties for the purposes of the Owners Corporations Act 2006.

2Authorising provision

These Regulations are made under section 204 of the OwnersCorporations Act 2006.

3Amendment of objective

After regulation 1(e) of the Owners Corporations Regulations 2007[1] insert

"(ea)offences in respect of which an infringement notice may be issued;".

4New regulation 18 inserted

After regulation 17 of the Owners Corporations Regulations 2007 insert

"18   Infringement offences and penalties

(1)Sections 127, 178 and 188 of the Act are prescribed as infringement offences for the purposes of section 203A(1) of the Act.

(2)For the purposes of section 203A(3) of the Act, the infringement penalty for an offence—

(a)against section 127 or 178 of the Act is 6 penalty units;

(b)against section 188 of the Act is 1 penalty unit.".
