Supreme Court (Chapter I Amendment No. 27) Rules 2011

The Judges of the Supreme Court make the following Rules:

1Object

The object of these Rules is to amend Chapter I of the Rules of the Supreme Court to—

(a)revoke Rule 4.11 and Form 4C as a consequence of the repeal of Chapter 3 of the Civil Procedure Act 2010 by the Civil Procedure and Legal Profession Amendment Act 2011;

(b)amend Rule 27.03 to address an inconsistency in relation to the fastening of documents;

(c)make minor statute law revision amendments.

2Authorising provisions

These Rules are made under section 25 of the Supreme Court Act 1986 and all other enabling powers.

3Commencement

These Rules come into operation on 1 August 2011.

4Principal Rules

In these Rules, the Supreme Court (General Civil Procedure) Rules 2005[1] are called the Principal Rules.

5Pre-litigation requirements compliance certification revoked

In the Principal Rules—

(a)Rule 4.11 is revoked;

(b)Form 4C is revoked.

6Form of document

(1)For Rule 27.03(2)(b) of the Principal Rules substitute—

"(b)the sheets of the document shall be securely fastened—

(i)at the top left hand corner; and

(ii)without obscuring the writing or the margin;".

(2)For Rule 27.03(13) of the Principal Rules substitute—

"(13)A document or copy document which is to be filed shall not be folded.".

7Statute law revision amendments

In the Principal Rules—

(a)in Rule 63.47(2)(b) omit "shall";

(b)in Rule 68.02(4)(d) for "he" substitute "the person liable";

(c)in Rule 69.04(1) for "he" substitute "the Sheriff";

(d)in Form 11B for "him" substitute "the defendant".
