Road Safety Act 1986

Road Safety (General) Amendment Regulations 2011

The Governor in Council makes the following Regulations:

1Objective

The objective of these Regulations is to amend the Road Safety (General) Regulations 2009 to—

(a)amend the summary of the infringement offence relating to level crossings;

(b)increase by 1 penalty unit the infringement penalties for offences relating to a motor cycle rider carrying a pillion passenger; and

(c)make a minor consequential amendment.

2Authorising provision

These Regulations are made under section 95 of the Road Safety Act 1986.

3Principal Regulations

In these Regulations, the Road Safety (General) Regulations 2009[1] are called the Principal Regulations.

4Prosecution for parking offences

In regulation 83(d) of the Principal Regulations, for "Director of Marine Safety" substitute "Director, Transport Safety within the meaning of section 3 of the Transport Integration Act 2010".

5Extension of the Act by the Minister

For regulation 85(b) of the Principal Regulations substitute—

"(b)Metro Trains Melbourne Pty Ltd

(ACN 136 429 948);".

6Schedule 7—Traffic Infringements

(1)In column 3 of item 29 of Schedule 7 to the Principal Regulations, after "at level crossing" insert "or unlawfully enter level crossing".

(2)In column 5 of item 71 of Schedule 7 to the Principal Regulations, for "2 penalty units" substitute "3 penalty units".

(3)In column 5 of item 72 of Schedule 7 to the Principal Regulations, for "2 penalty units" substitute "3 penalty units".

(4)In column 5 of item 73 of Schedule 7 to the Principal Regulations, for "2 penalty units" substitute "3 penalty units".
