Magistrates' Court (Arbitration) (Professional Costs) Amendment Regulations 2011

The Lieutenant-Governor as the Governor's deputy with the advice of the Executive Council makes the following Regulations:

1Objective

The objective of these Regulations is to amend the Magistrates' Court (Arbitration) Regulations 2010—

(a)to increase the allowances for professional costs which may be awarded to a party in respect of an arbitration under Division 2 of Part 5 of the Magistrates' Court Act 1989; and

(b)as a consequence of the commencement of the Magistrates' Court General Civil Procedure Rules 2010.

2Authorising provision

These Regulations are made under section 140 of the Magistrates' Court Act 1989.

3Commencement

These Regulations come into operation on 12 September 2011.

4Amendments to Schedule 3

In clause 1 of Schedule 3 to the Magistrates' Court (Arbitration) Regulations 2010[1]—

(a)in paragraphs (a) and (c), for "$1243" substitute "$1307";

(b)in paragraphs (b) and (d), for "$1340" substitute "$1409";

(c)in paragraphs (e) and (f), for "$1437" substitute "$1511";

(d)in paragraph (g)—

(i)in subparagraph (i), for "$234" substitute "$246";

(ii)in subparagraph (ii), for "$291" substitute "$306";

(iii)in subparagraph (iii), for "$350" substitute "$368";

(e)for "Magistrates' Court Civil Procedure Rules 2009" substitute "Magistrates' Court General Civil Procedure Rules 2010".
