Supreme Court (Chapter VI Amendment No. 7) Rules 2011

The Judges of the Supreme Court make the following Rules:

1Object

The object of these Rules is to amend the Supreme Court (Criminal Procedure) Rules 2008 to provide for the Registrar of Criminal Appeals to constitute the Court of Appeal for the purposes of making an order for an appellant in custody to attend court in accordance with Rule 2.36.

2Authorising provisions

These Rules are made under section 25 of the Supreme Court Act 1986, the Criminal Procedure Act 2009 and all other enabling powers.

3Commencement

These Rules come into operation on 7 November 2011.

4Attendance of appellant

After Rule 2.36(4) of the Supreme Court (Criminal Procedure) Rules 2008[1] insert—

"(5)The Registrar may constitute the Court of Appeal for the purposes of making an order to bring an appellant who is in custody before the Court pursuant to—

(a)regulations made under the Corrections Act 1986; or

(b)section 490 of the Children, Youth and Families Act 2005.

(6)For the purposes of paragraph (5), the powers of the Court of Appeal to make an order referred to in that paragraph are delegated to the Registrar.".
