Transport (Conduct) and (Ticketing) Amendment (Protective Services Officers) Regulations 2011
The Governor in Council makes the following Regulations:

1Objective
(1)The objective of these Regulations is to support the operation of the scheme to deploy protective services officers at or in the vicinity of railway stations by enabling protective services officers to enforce conduct and ticketing requirements.
(2)The Regulations achieve this objective by—
(a)amending the Transport (Conduct) Regulations 2005 to extend the definition of authorised officer (conduct) to include protective services officers; and
(b)amending the Transport (Ticketing) Regulations 2006 to extend the definition of authorised officer (ticketing); and
(c)amending regulation 19 of the Transport (Ticketing) Regulations 2006 to enable a protective services officer to request the surrender of a ticket; and
(d)amending regulation 22 of the Transport (Ticketing) Regulations 2006 to include protective services officers within the exemption under that regulation.
2Authorising provisions
These Regulations are made under sections 56 and 221AA of the Transport (Compliance and Miscellaneous) Act 1983.
3Commencement
These Regulations come into operation on the day on which section 4 of the Justice Legislation Amendment (Protective Services Officers) Act 2011 comes into operation.
4Amendment of regulation 3 of the Transport (Conduct) Regulations 2005
In regulation 3(1) of the Transport (Conduct) Regulations 2005[1]—
(a)in the definition of authorised person (conduct) after paragraph (b) insert—
"(ba)a protective services officer; or";
(b)insert the following definition—
"protective services officer means a protective services officer appointed under section 118B(1) of the Police Regulation Act 1958;".
5Amendment of regulation 5 of the Transport (Ticketing) Regulations 2006
In regulation 5(1) of the Transport (Ticketing) Regulations 2006[2]—
(a)in the definition of authorised person (ticketing) after paragraph (b) insert—
"(ba)a protective services officer; or";
(b)insert the following definition—
"protective services officer means a protective services officer appointed under section 118B(l) of the Police Regulation Act 1958;".
6Amendment of regulation 19 of the Transport (Ticketing) Regulations 2006
(1)In regulation 19(1) of the Transport (Ticketing) Regulations 2006—
(a)for "or a member of the police force" substitute ", a member of the police force or a protective services officer".
(b)for "authorised officer or the member" substitute "officer or member" where twice occurring.
(2)In regulation 19(3) of the Transport (Ticketing) Regulations 2006 for "or member of the police force" substitute ", a member of the police force or a protective services officer".
7Amendment of regulation 22 of the Transport (Ticketing) Regulations 2006
In regulation 22(a) of the Transport (Ticketing) Regulations 2006 after "police force" insert
", a protective services officer".
