Infringements (General) Further Amendment Regulations 2011

The Governor in Council makes the following Regulations:

1Objective

The objective of these Regulations is to amend the Infringements (General) Regulations 2006—

(a)to prescribe certain infringement offences under the Funerals Act 2006, Conservation, Forests and Lands Act 1987 and the Sex Work Act 1994 as lodgeable infringement offences for the purposes of the Infringements Act 2006; and

(b)to make other amendments of a minor or consequential nature to the Infringements (General) Regulations 2006.

2Commencement

These Regulations come into operation on 29 November 2011.

3Authorising provision

These Regulations are made under section 168 of the Infringements Act 2006.

4Principal Regulations

In these Regulations, the Infringements (General) Regulations 2006[1] are called the Principal Regulations.

5Information to be lodged with the Court

For regulation 13(c) of the Principal Regulations substitute—

"(c)in respect of the enforcement agency, the name of the enforcement agency.".

6Prescribed information when matter referred to Court

For regulation 16(c) of the Principal Regulations substitute—

"(c)in respect of the enforcement agency, the name of the enforcement agency.".

7Schedule 3 amended

(1)In item 1AA of Schedule 3 to the Principal Regulations—

(a)items 1AA.1 to 1AA.8 are revoked;

(b)after item 1AA.10 insert—

"1AA.11Regulations 7(2), 8(1), 8(2), 8(3), 8(4), 8(7), 9(1), 14(3), 15(2), 16, 17(2), 19(2), 20(3), 21(1), 21(3), 23(1), 23(3), 23(4), 24(1), 24(2), 25(2), 32(1), 32(3), 32(4), 33(3), 33(4), 34(3), 34(4), 35(1), 35(2), 35(3), 35(5), 36(3), 36(5), 36(7), 37(3)(a), 37(6), 38(1), 39(1)(a), 39(1)(b), 39(1)(c), 45(1), 45(2), 46(2), 47(2), 48(2), 48(3), 49(3), 49(6), 50(2), 51(3)(a), 51(6), 53(1), 56(1), 56(2), 57(3), 57(4) and 57(7) of the Forests (Recreation) Regulations 2010.".

(2)After item 4 of Schedule 3 to the Principal Regulations insert—

"4A Funerals Act 2006

4A.1Sections 10(1), 10(2), 11(2), 18(2), 21(1), 22, 23, 24(1), 24(2), 24(3), 24(4), 24(5), 28(5), 33(1), 42, 43, 49(1), 50(1) and 51.".

(3)In item 11.6 of Schedule 3 to the Principal Regulations—

(a)omit "19(1), 19(2), 19(3), 19(4),";

(b)omit "23(2), 23(5), 23(7),";

(c)for "30(1)(c)," substitute "30(1)(c)";

(d)omit "30(2)(a), 30(2)(b), 30(2)(c), 31(3), 31(4), 31(5)".

(4)In item 11.7 of Schedule 3 to the Principal Regulations omit "42(2),".

8Schedule 4 amended

(1)After item 2A.89 of Schedule 4 to the Principal Regulations insert—

"2A.90Section 13(5) constituted by a contravention of regulation 8(1) of the Crown Land (Reserves) (Phillip Island Nature Park) Regulations 2010.
