Education and Training Reform Amendment Regulations 2011
The Governor in Council makes the following Regulations:

1Objective
The objective of these Regulations is to amend the Education and Training Reform Regulations 2007 in relation to elections for the Council of the Victorian Institute of Teaching.
2Authorising provisions
These Regulations are made under sections 5.10.1 and 5.10.2 of, and Schedule 5 to, the Education and Training Reform Act 2006.
3Principal Regulations
In these Regulations, the Education and Training Reform Regulations 2007[1] are called the Principal Regulations.
4Roll of electors
In regulation 104(3) of the Principal Regulations, for "2.6.6(4)" substitute "2.6.6B".
5Election dates
In regulation 106(1)(a) of the Principal Regulations, for "2.6.6(4)" substitute "2.6.6B".
6Nominations
(1)In regulation 108(1) of the Principal Regulations, for "2.6.6(4)(a)" substitute "2.6.6B".
(2)Regulation 108(2) of the Principal Regulations is revoked.
(3)In regulation 108(4) and (5)(a) of the Principal Regulations, for "2.6.6(4)" (wherever occurring) substitute "2.6.6B".
7Counting votes if only one member is to be elected
(1)In regulation 126(1) of the Principal Regulations, for "2.6.6(4)(a)(ii), (iv), (v) or (vi) or 2.6.6(4)(b)(i) or (ii)" substitute "2.6.6B(b), (c), or (d)".
8Counting votes if more than one member may be elected
(1)In the heading to regulation 127 of the Principal Regulations, for "2 members are to" substitute "more than one member may".
(2)In regulation 127(1) of the Principal Regulations—
(a)for "2" substitute "one or more";
(b)for "2.6.6(4)(a)(i) or (iii)" substitute "2.6.6B(a)".
(3)After regulation 127(8) of the Principal Regulations insert—
'(9)The third vacancy is to be filled in the manner specified in subregulations (4), (5), (6), (7) and (8) as if—
(a)the reference in subregulation (4)(c) to "the elected candidate" were a reference to "the first and second elected candidates"; and
(b)the reference in subregulations (6) and (8) to "the second vacancy" were a reference to "the third vacancy".'.
