Transport (Compliance and Miscellaneous) Act 1983

Transport (Conduct), (Passenger Vehicles) and (Ticketing) Amendment (Public Transport Development Authority) Regulations 2012

The Governor in Council makes the following Regulations:

PART 1—PRELIMINARY

1Objective

The objective of these Regulations is to facilitate the establishment of the Public Transport Development Authority by making consequential and other changes to Regulations made under the Transport (Compliance and Miscellaneous) Act 1983.

2Authorising provisions

These Regulations are made under sections 56, 162, 215 and 221AA of the Transport (Compliance and Miscellaneous) Act 1983.

3Commencement

These Regulations come into operation on 2 April 2012.

PART 2—CONSEQUENTIAL AMENDMENTS TO THE TRANSPORT (CONDUCT) REGULATIONS 2005

4Interpretation

In regulation 3(1) of the Transport (Conduct) Regulations 2005[1], in paragraph (d) of the definition of authorised person (conduct), for "Director" substitute "Public Transport Development Authority".

5Dogs and other animals on vehicles or rail premises

(1)In regulation 20(3) of the Transport (Conduct) Regulations 2005 omit "by the Director".

(2)In the note at the foot of regulation 20(3) of the Transport (Conduct) Regulations 2005 omit "by the Director".

PART 3—CONSEQUENTIAL AMENDMENTS TO THE TRANSPORT (PASSENGER VEHICLES) REGULATIONS 2005

6Carriage of animals

(1)In regulation 72(1)(a) of the Transport (Passenger Vehicles) Regulations 2005[2] omit "by the Director".

(2)In the note at the foot of regulation 72(1) of the Transport (Passenger Vehicles) Regulations 2005 omit "by the Director".

PART 4—CONSEQUENTIAL AMENDMENTS TO THE TRANSPORT (TICKETING) REGULATIONS 2006

7Definitions and reference provisions

In regulation 5(1) of the Transport (Ticketing) Regulations 2006[3]—

(a)in paragraph (d) of the definition of authorised person (ticketing), for "Director" substitute "Public Transport Development Authority";

(b)in paragraph (b) of the definition of designated area, for "Director" substitute "Secretary".

8Ticket contracts

In regulation 15(1) of the Transport (Ticketing) Regulations 2006, for "or the Secretary or the Director on behalf of the Crown" substitute "or the Secretary on behalf of the Crown or the Public Transport Development Authority".

9Exemptions

(1)In regulation 22(c)(ii) of the Transport (Ticketing) Regulations 2006, for "Director" substitute "Public Transport Development Authority".

(2)In regulation 22(d) of the Transport (Ticketing) Regulations 2006, for "Director" substitute "Public Transport Development Authority".
