Energy Legislation Amendment (Publication of Retail Offers) Act 2015

The Parliament of Victoria enacts:
PART 1—PRELIMINARY
1Purposes
The purposes of this Act are—
(a)to amend the Electricity Industry Act 2000 to require retailers who are relevant licensees to input general renewable energy feed-in terms and conditions into an Internet site nominated by the Minister; and
(b)to amend the Gas Industry Act 2001 to change the publication requirements in respect of gas retailer licensee standing offers and relevant published offers so that the requirements align with the requirements for electricity retailer licensee standing offers and relevant published offers under the Electricity Industry Act 2000.
2Commencement
(1)Subject to subsection (2), this Act comes into operation on a day or days to be proclaimed.
(2)If a provision of this Act does not come into operation before 1 May 2016, it comes into operation on that day.
PART 2—AMENDMENT OF ELECTRICITY INDUSTRY ACT 2000
3Retailer licence condition relating to purchase of small renewable energy generation electricity
(1)In section 40G(1) of the Electricity Industry Act 2000, for "to publish general renewable energy feed-in terms and conditions." substitute
"—
(a)to publish general renewable energy feed-in terms and conditions; and
(b)to, as soon as practicable after the licensee publishes the terms and conditions in accordance with this section but before the terms and conditions take effect, input the terms and conditions into an Internet site nominated by the Minister so that the terms and conditions are able to be published on the Internet.".
(2)Insert the following note at the foot of section 40G(1) of the Electricity Industry Act 2000—
"Note
General renewable energy feed-in terms and conditions take effect 2 months after they are published unless they have been referred to the Commission for assessment—see section 40H.".
4New section 40MAA inserted
After section 40M of the Electricity Industry Act 2000 insert—
"40MAA Relevant licensee must input declared general feed-in terms and conditions into Minister nominated Internet site
(1)This section applies to a relevant licensee named in a declaration under section 40M.
(2)The relevant licensee must, as soon as practicable after the declaration is published in the Government Gazette, input the ESC recommended general feed-in terms and conditions or ESC determined general feed‑in terms and conditions that are the subject of the declaration into an Internet site nominated by the Minister so that the terms and conditions are able to be published on the Internet.
Note
The relevant licensee must also publish the ESC recommended general feed-in terms and conditions or ESC determined general feed-in terms and conditions on its Internet site—see section 40N.".
PART 3—AMENDMENT OF GAS INDUSTRY ACT 2001
5Licensee standing offer tariffs to be given to Commission
In section 42A of the Gas Industry Act 2001—
(a)omit "to, on the same day the licensee publishes tariffs in accordance with section 42"; and
(b)for paragraphs (a) and (b) substitute—
"(a)to, as soon as practicable after the licensee publishes tariffs in accordance with section 42, input those tariffs into an Internet site nominated by the Minister so that the tariffs are able to be published on the Internet; and
(b)if an Internet site has not been nominated by the Minister for the purposes of paragraph (a), to, on the same day the licensee publishes tariffs in accordance with section 42—
(i)give a copy of those tariffs to the Commission; and
(ii)inform the Commission, in writing, of the day those tariffs take effect.".
6New section 42B substituted
For section 42B of the Gas Industry Act 2001 substitute—
"42B Commission must publish on Internet licensee standing offer tariffs
The Commission must publish on its Internet site tariffs it is given under section 42A(b) on the day those tariffs take effect.".
7Publication of tariffs, terms and conditions of sale of gas (relevant published offers)
(1)For section 43A(1)(b) of the Gas Industry Act 2001 substitute—
"(b)to, as soon as practicable after details of the tariffs, terms and conditions are published in accordance with paragraph (a), input those details into an Internet site nominated by the Minister so that the tariffs are able to be published on the Internet; and
(c)if an Internet site has not been nominated by the Minister for the purposes of paragraph (b), to, on the same day the retailer publishes the details of the tariffs, terms and conditions in accordance with paragraph (a), give a copy of those details to the Commission.".
(2)In section 43A(1A) of the Gas Industry Act 2001, for "subsection (1)(b)" substitute "subsection (1)(c)".
PART 4—REPEAL OF AMENDING ACT
8Repeal of amending Act
This Act is repealed on 1 May 2017.
Note
The repeal of this Act does not affect the continuing operation of the amendments made by it (see section 15(1) of the Interpretation of Legislation Act 1984).
