Water (Lake Eildon Recreational Area) (Houseboats) Amendment Regulations 2012

The Lieutenant-Governor as the Governor's deputy with the advice of the Executive Council makes the following Regulations:

1Objective

The objective of these Regulations is to amend the Water (Lake Eildon Recreational Area) (Houseboats) Regulations 2003—

(a)to amend the size restrictions on houseboats that may be licensed to operate on Lake Eildon; and

(b)to remove annual licence fees for houseboats.

2Authorising provisions

These Regulations are made under sections 122ZF and 324 of the Water Act 1989.

3Principal Regulations

In these Regulations the Water (Lake Eildon Recreational Area) (Houseboats) Regulations 2003[1] are called the Principal Regulations.

4Annual licence

(1)In regulation 6(2) of the Principal Regulations—

(a)for paragraph (b), substitute

"(b)the houseboat is not more than 20 metres in length and not more than 8 metres in width; and";

(b)in paragraph (f), for "Type 1 houseboat referred to in Schedule 3" substitute "trailable houseboat";

(c)in paragraph (g), for "Parts 1 and 2" substitute "Part 2".

(2)In regulation 6(5) of the Principal Regulations omit "for a Type 2, 3a, 3b, 4a, 4b or 5 houseboat referred to in Schedule 3".

5Restricted term licence

For regulation 7(2)(d) of the Principal Regulations substitute

"(d)a fee of 6·51 fee units has been paid.".

6Structural alteration to a houseboat

In regulation 9(1) of the Principal Regulations, omit "that would result in an increased fee being payable under Schedule 3,".

7Scale of fees for houseboat licences

(1)For the Heading to Schedule 3 substitute

"FEES FOR HOUSEBOAT LICENCES".

(2)Part 1 of Schedule 3 is revoked.
