Infringements (General) Amendment (Further Lodgeable Infringement Offences) Regulations 2012

1Objective

The objective of these Regulations is to amend the Infringements (General) Regulations 2006 to prescribe certain infringement offences under the Marine (Drug, Alcohol and Pollution Control) Act 1988, the Marine Safety Act 2010, the Port Management Act 1995 and the Sex Work Act 1994 as lodgeable infringement offences for the purposes of the Infringements Act 2006.

2Authorising provision

These Regulations are made under section 168 of the Infringements Act 2006.

3Commencement

These Regulations come into operation on 1 July 2012.

4Principal Regulations

In these Regulations, the Infringements (General) Regulations 2006[1] are called the Principal Regulations.

5Item 7B substituted and new item 7BA inserted—Schedule 4

For item 7B of Schedule 4 to the Principal Regulations substitute—

7BMarine (Drug, Alcohol and Pollution Control) Act 1988"

7B.1Section 28(1)(b).

7BAMarine Safety Act 2010

7BA.1Sections 37(1), 37(2), 37(3), 46(1), 46(2), 47(1), 47(2), 49(1), 49(2), 50(1), 50(2), 59, 61, 62(1) and 62(2).

7BA.2Section 63(1) constituted by a failure to comply with regulation 63(2)(a) of the Marine Safety Regulations 2012 in relation to a standard specified in regulations 58(j), 59(b), 60(2)(f) or 61(2)(f) of those Regulations.

7BA.3Section 63(1) constituted by a failure to comply with regulation 63(2)(d) of the Marine Safety Regulations 2012.

Note

Notice is defined in the Transport (Infringements) Regulations 2010 as Notice No. 1 made under section 15(2) of the Marine Act 1988 published in the Government Gazette Number G 26 on 2 July 1998 (pages 1706 to 1824) as amended from time to time. That Notice is taken to be waterway rules under section 342 of the Marine Safety Act 2010.

7BA.6Section 197 constituted by a failure to comply with clause 2(b) of the Notice as defined in the Transport (Infringements) Regulations 2010 which is taken to be waterway rules by section 342 of the Act.

6New item 8B inserted into Schedule 4

After item 8A of Schedule 4 to the Principal Regulations insert—

8BPort Management Act 1995"

8B.1Regulations 206, 207, 208(1), 209(1), 210(1), 210(2), 211(1), 211(2), 300(1), 301(1), 400, 531(3) and 532(3) of the Port Services (Local Ports) Regulations 2004.".

7Schedule 4 amended—Sex Work Act 1994

(1)In item 12.1 of Schedule 4 to the Principal Regulations—

(a)after "Sections" insert "17(1)(a), 17(1)(b), 17(2), 17(3)(a), 17(3)(b), 17(4)(a), 17(4)(b), 21(1)(a), 21(1)(b),";

(b)after "41," insert "52(4), 60A(1),".

(2)After item 12.1 of Schedule 4 to the Principal Regulations insert—

"12.2Regulations 7(3), 7(3A) and 7(3B) of the Sex Work Regulations 2006.".
