Port Services (Local Ports) Amendment Regulations 2012

The Governor in Council makes the following Regulations:

1Objective

The objective of these Regulations is to amend the Port Services (Local Ports) Regulations 2004 as a consequence of the enactment of the Transport Integration Act 2010.

2Authorising provision

These Regulations are made under section 98 of the Port Management Act 1995.

3Commencement date

These Regulations commence on 1 July 2012.

4    Title of Port Services (Local Ports) Regulations 2004 substituted

For the title to the Port Services (Local Ports) Regulations 2004[1] substitute—

"Port Management (Local Ports) Regulations 2004".

5Objective—2004 Regulations

In regulation 100 of the Port Services (Local Ports) Regulations 2004, for "Port Services" substitute "Port Management".

6Authorising provision—2004 Regulations

In regulation 101 of the Port Services (Local Ports) Regulations 2004, for "Port Services" substitute "Port Management".

7Definitions

In regulation 103 of the Port Services (Local Ports) Regulations 2004, in the definition of Act, for "Port Services" substitute "Port Management".

8Exemptions from the operation of the Regulations

In regulation 104(1)(g) of the Port Services (Local Ports) Regulations 2004, for "Director of Marine Safety" (wherever occurring) substitute "Director, Transport Safety".

9Use of whistles, sirens or bells on vessel

In regulation 315(2)(b) of the Port Services (Local Ports) Regulations 2004, for "Director of Marine Safety" substitute "Director, Transport Safety".

10New regulation 109 inserted

After regulation 108 of the Port Services (Local Ports) Regulations 2004, insert—

"109 Construction of references to the Port Services (Local Ports) Regulations 2004

On and from 1 July 2012, unless the contrary intention appears, a reference in any subordinate instrument, agreement or other document to the Port Services (Local Ports) Regulations 2004 is to be construed as a reference to the Port Management (Local Ports) Regulations 2004.".
