Residential Tenancies Act 1997

Residential Tenancies Amendment (Infringements) Regulations 2012

The Governor in Council makes the following Regulations:

1Objective

The objective of these Regulations is to amend the Residential Tenancies Regulations 2008 to prescribe offences under section 142B of the Residential Tenancies Act 1997 as infringement offences and prescribe infringement penalties for those offences.

2Authorising provision

These Regulations are made under section 511 of the Residential Tenancies Act 1997.

3Commencement

These Regulations come into operation on 31 March 2013.

4Schedule 2—Infringement offences and infringement penalties

In Schedule 2 to the Residential Tenancies Regulations 2008[1] after item 31 insert

"31A An offence against section 142B(1) of the Act

In the case of a natural person 5 penalty units

In the case of a body corporate 20 penalty units

31B An offence against section 142B(2) of the Act

In the case of a natural person 5 penalty units

In the case of a body corporate 20 penalty units

31C An offence against section 142B(3) of the Act

In the case of a natural person 5 penalty units

In the case of a body corporate 20 penalty units".
