Offshore Petroleum and Greenhouse Gas Storage Amendment Regulations 2012
The Governor in Council makes the following Regulations:

1Objective
The objective of these Regulations is to amend the Offshore Petroleum and Greenhouse Gas Storage Regulations 2011 to—
(a)increase the maximum penalty for certain offences to align with regulations made under the Commonwealth Act;
(b)apply Part 5.5 of those Regulations to holders of petroleum access authorities and greenhouse gas special authorities;
(c)make other minor and consequential amendments.
2Authorising provision
These Regulations are made under section 794 of the Offshore Petroleum and Greenhouse Gas Storage Act 2010.
3Commencement
These Regulations come into operation on 1 December 2012.
4Principal Regulations
In these Regulations, the Offshore Petroleum and Greenhouse Gas Storage Regulations 2011[1] are called the Principal Regulations.
5Definitions
In regulation 6 of the Principal Regulations, in paragraph (a) of the definition of reportable incident, for "environmental consequences; or" substitute "environmental consequences; and".
6Accepted environment plan required for an activity
For the penalty at the foot of regulation 8(1) of the Principal Regulations, substitute—
"Penalty:In the case of a body corporate, 400 penalty units;
In the case of a natural person, 80 penalty units.".
7Operations must comply with the accepted environment plan
For the penalty at the foot of regulation 9(1) of the Principal Regulations, substitute—
"Penalty:In the case of a body corporate, 400 penalty units;
In the case of a natural person, 80 penalty units.".
8Operations must not continue if new or increased environmental risk identified
(1)For the penalty at the foot of regulation 10(1) of the Principal Regulations, substitute—
"Penalty:In the case of a body corporate, 400 penalty units;
In the case of a natural person, 80 penalty units.".
(2)For the penalty at the foot of regulation 10(2) of the Principal Regulations, substitute—

9Notifying reportable incidents
For the penalty at the foot of regulation 29(1) of the Principal Regulations, substitute—

10Written report of reportable incidents
For the penalty at the foot of regulation 30(1) of the Principal Regulations, substitute—

For the penalty at the foot of regulation 87 of the Principal Regulations, substitute—
"Penalty:In the case of a body corporate, 400 penalty units;
In the case of a natural person, 80 penalty units.".
17Safety case required for the relevant stage in the life of a facility
For the penalty at the foot of regulation 88 of the Principal Regulations, substitute—
"Penalty:In the case of a body corporate, 400 penalty units;

18Work on a facility must comply with the safety case

"(d)if the plan is for undertaking a well activity authorised by a petroleum access authority or a greenhouse gas special authority relating to a deviation well, must be the same as the accepted well operations management plan in force for undertaking that well activity in a title area adjacent to the authority area.".
