Infringements (General) (Lodgeable Infringement Offences) Amendment Regulations 2012
The Governor in Council makes the following Regulations:

1Objective
The objective of these Regulations is to amend the Infringements (General) Regulations 2006—
(a)to prescribe certain infringement offences under the Environment Protection Act 1970, the Marine (Drug, Alcohol and Pollution Control) Act 1988, the Marine Safety Act 2010, the Supported Residential Services (Private Proprietors) Act 2010, the Tobacco Act 1987, the Transport (Compliance and Miscellaneous) Act 1983 and the Water Act 1989 as lodgeable infringement offences for the purposes of the Infringements Act 2006; and
(b)to make other amendments.
2Authorising provision
These Regulations are made under section 168 of the Infringements Act 2006.
3Commencement
These Regulations come into operation on 12 December 2012.
4Principal Regulations
In these Regulations, the Infringements (General) Regulations 2006[1] are called the Principal Regulations.
5Schedule 3 amended—Tobacco Act 1987
In item 10A.1 of Schedule 3 to the Principal Regulations, after "5R(1)," insert "5RA(1), 5RA(4),".
6Schedule 3 amended—Transport (Compliance and Miscellaneous) Act 1983
In item 11.2 of Schedule 3 to the Principal Regulations, for "and 223." substitute
", 223, 228ZBA(3) and 228ZM(2).".
7Schedule 3 amended—Water Act 1989
(1)For item 12.9 of Schedule 3 to the Principal Regulations substitute—
"12.9Clause 10 of Model Water Restriction
By-Law No. 105.".
(2)For item 12.12 of Schedule 3 to the Principal Regulations substitute—
"12.12Clause 10 of Water Restriction
By-Law No. 512.".
8Schedule 4 amended—Environment Protection Act 1970
Before item 4A.1 of Schedule 4 to the Principal Regulations insert—
"4A.1AASections 26F(1), 26F(2), 26F(3), 26J, 26M and 26O.".
9Schedule 4 amended—Marine (Drug, Alcohol and Pollution Control) Act 1988
For item 7B.1 of Schedule 4 to the Principal Regulations substitute—
"7B.1Sections 28(1)(b) and 28(1)(bb).".
10Schedule 4 amended—Marine Safety Act 2010
(1)In item 7BA.4 of Schedule 4 to the Principal Regulations, for "and 74." substitute ", 74, 162A(4), 162A(5) and 162C.".
(2)In item 7BA.36 of Schedule 4 to the Principal Regulations, after "Regulations" (where first occurring) insert "15, 16, 17, 18,".
11New item 13 inserted into Schedule 4
After item 12 of Schedule 4 to the Principal Regulations insert—
13Supported Residential Services (Private Proprietors) Act 2010"
13.1Sections 18, 30, 34, 37, 45(2), 45(3), 46(1), 46(2), 46(3), 47(2), 48(2), 56(1), 57(2), 58(7), 68(1), 74(2), 76(1), 76(2), 76(3), 76(4), 77(1), 79(1), 79(3), 80(1), 80(2), 90(1), 90(2), 91(1), 91(2), 94, 99, 118, 158, 163 and 192.
13.2Regulation 26 of the Supported Residential Services (Private Proprietors) Regulations 2012.".
12Statute law revision amendments
(1)Item 10 of Schedule 4 to the Principal Regulations is revoked.
(2)After item 12.1 of Schedule 4 to the Principal Regulations insert—
"12.1ASections 21G(1), 21G(2), 40A(3), 52A(3), 58(a), 58(b), 58(c), 59(3)(a), 60(1) and 60(2).".
