Road Safety Act 1986

Road Safety (Vehicles) Amendment Regulations 2012

The Governor in Council makes the following Regulations:

1Objective

The objective of these Regulations is to amend the Road Safety (Vehicles) Regulations 2009—

(a)in relation to number plates; and

(b)to expand the definition of emergency vehicle.

2Authorising provision

These Regulations are made under section 95 of the Road Safety Act 1986.

3Offences—Use of vehicles and number plates

(1)In the heading to regulation 50 of the Road Safety (Vehicles) Regulations 2009[1], after "Offence" insert "—use of vehicles and number plates".

(2)For regulation 50(1) of the Road Safety (Vehicles) Regulations 2009 substitute

"(1)A driver of a vehicle must not use a vehicle on a highway unless—

(a)the vehicle bears number plates affixed and displayed in accordance with this Part; or

(b)an authority under regulation 50A applies to the vehicle.".

(3)After regulation 50(2) of the Road Safety (Vehicles) Regulations 2009 insert

"(3)For the purposes of subregulation (2), a registered operator of a vehicle is exempt if the vehicle bears number plates affixed and displayed in accordance with an authority under regulation 50A.".

4New regulation 50A inserted

After regulation 50 of the Road Safety (Vehicles) Regulations 2009 insert

50AAuthority given by Corporation"

(1)For the purpose of testing the ability of equipment used for road safety, enforcement or tolling purposes to read number plates or registration numbers, the Corporation may give an authority under this Division.

(2)The authority must be in writing and may—

(a)apply in respect of a particular case or a class of cases as specified in the authority; and

(b)permit the affixture and display of multiple number plates; and

(c)specify the manner in which number plates may be affixed and displayed; and

(d)be subject to any specified conditions.".

5Schedule 2—Definitions

In clause 3 of Schedule 2 to the Road Safety (Vehicles) Regulations 2009, in the definition of emergency vehicle, for paragraph (ba) substitute

"(ba)a vehicle under the control of the Fire Services Commissioner appointed under the Fire Services Commissioner Act 2010;".
