County Court (Chapter I Amendment No. 5) Rules 2012

A majority of the Judges of the County Court makes the following Rules:

1Object

The object of these Rules is to amend Order 44 of Chapter I of the Rules of the County Court to provide for exemptions from the requirements of section 65G of the Civil Procedure Act 2010.

2Authorising provisions

These Rules are made under section 78 of the County Court Act 1958, sections 65G and 70 of the Civil Procedure Act 2010 and all other enabling powers.

3Commencement

These Rules come into operation on 24 December 2012.

4Division heading inserted in Order 44

In Order 44 of the County Court Civil Procedure Rules 2008[1], before Rule 44.01 insert

"Division 1—General".

5New Division 2 of Order 44

After Rule 44.06 of the County Court Civil Procedure Rules 2008 insert

"Division 2—Civil Procedure Act 2010

44.07Exemption from requirement that party seek direction of court to adduce expert evidence

(1)Subject to paragraph (2), the requirements of section 65G of the Civil Procedure Act 2010 to seek direction from the Court to adduce expert evidence do not apply to a party to a civil proceeding in—

(a)the Damages and Compensation List;

(b)any Division of the Damages and Compensation List specified in Rule 34A.04;

(c)the Commercial List;

(d)any Division of the Commercial List specified in Rule 34A.06.

(2)Paragraph (1) does not apply if—

(a)the Court orders that a party must seek directions in accordance with section 65G of the Act; or

(b)a practice note requires a party to seek directions in respect of proceedings to which that practice note applies.".
