Corrections Amendment Regulations 2013

The Lieutenant-Governor as the Governor's deputy with the advice of the Executive Council makes the following Regulations:

1Objective

The objective of these Regulations is to amend the Corrections Regulations 2009 to update references to various offices and office-holders as a consequence of—

(a)the enactment of the Independent Broad-based Anti-corruption Commission Act 2011 and the Victorian Inspectorate Act 2011; and

(b)amendments to those Acts by the Integrity and Accountability Legislation Amendment Act 2012.

2Authorising provision

These Regulations are made under section 112 of the Corrections Act 1986.

3Commencement

These Regulations come into operation on 10 February 2013.

4Principal Regulations

In these Regulations, the Corrections Regulations 2009[1] are called the Principal Regulations.

5Definition

In regulation 5(1) of the Principal Regulations insert the following definition—

"Ombudsman officer has the same meaning as it has in the Ombudsman Act 1973;".

6Control of letters and parcels

For regulation 17(3)(a) and (b) of the Principal Regulations substitute

"(a)an Ombudsman officer; or

(b)the IBAC or an IBAC Officer within the meaning of the Independent Broad-based Anti-corruption Commission Act 2011; or

(c)the Victorian Inspectorate or a Victorian Inspectorate Officer within the meaning of the Victorian Inspectorate Act 2011.".

7Restrictions of communications during emergency

In regulation 19(b) of the Principal Regulations for "the Ombudsman, the Ombudsman's officers" substitute "an Ombudsman officer".

8Compliance with terms of visit

For regulation 67(5)(f) of the Principal Regulations substitute

"(f)an Ombudsman officer;".
