Crimes (Controlled Operations) Further Amendment Regulations 2013

The Governor in Council makes the following Regulations:

1Objective

The objective of these Regulations is to amend the Crimes (Controlled Operations) Regulations 2008 to update certain definitions in those Regulations relating to delegations under the Crimes (Controlled Operations) Act 2004 in respect of the Independent Broad-based Anti-corruption Commission.

2Authorising provision

These Regulations are made under section 47 of the Crimes (Controlled Operations) Act 2004.

3Prescribed IBAC Officers

In regulation 6 of the Crimes (Controlled Operations) Regulations 2008[1]—

(a)in paragraph (b), for "Officer." substitute "Officer;";

(b)after paragraph (b) insert

"(c)IBAC Officers classified as Executive Officers.".

4New regulation 7 inserted

After regulation 6 of the Crimes (Controlled Operations) Regulations 2008 insert

"7   Prescribed senior officers

For the purposes of the definition of senior officer in section 45(2) of the Crimes (Controlled Operations) Act 2004, the following positions and classes of employees are prescribed—

(a)the position of Deputy Commissioner;

(b)the position of Chief Executive Officer;

(c)IBAC Officers classified as Executive Officers.".
