Electricity Safety Act 1998
Electricity Safety (Management) Amendment Regulations 2013
The Governor in Council makes the following Regulations:

1Objective
The objective of these Regulations is to amend the Electricity Safety (Management) Regulations 2009—
(a)to provide for network operators as a class of persons who submit electricity safety management schemes under Division 2 of Part 10 and section 116 of the Act; and
(b)to prescribe a standard for the electricity safety management system to be specified in the electricity safety management scheme of a network operator; and
(c)to make consequential amendments.
2Authorising provisions
These Regulations are made under sections 150 and 157 of the Electricity Safety Act 1998.
3Commencement
These Regulations come into operation on 1 November 2013.
4Principal Regulations
In these Regulations, the Electricity Safety (Management) Regulations 2009[1] are called the Principal Regulations.
5Definitions
In regulation 5 of the Principal Regulations—
(a)insert the following definitions—
'AS 5577 means Australian Standard AS 5577, "Electricity network safety management systems", as published or amended from time to time;
asset operator means an owner of an electrical installation that has an installed generation capacity of equal to or greater than 1000 kVA who is entitled to submit an electricity safety management scheme under section 116 of the Act;
network operator means—
(a)an MEC; or
(b)an owner of an electric line that is on land that is not owned or leased by the owner or operator of the electric line and who is entitled to submit an electricity safety management scheme under section 116 of the Act;';
(b)in paragraphs (a) and (b) of the definition of employer operator, for "make an application" substitute "submit an electricity safety management scheme";
(c)the definition of relevant asset operator is revoked;
(d)for the definition of scheme operator substitute—
"scheme operator means an asset operator, employer operator or network operator;".
6Meaning of access authority system
(1)In regulation 6(1) of the Principal Regulations, after "applicable asset" (where first occurring) insert "of an asset operator".
(2)In regulation 6(1)(c) of the Principal Regulations, for "relevant asset operator" substitute "asset operator".
7Person responsible for supply network or installation, or carrying out of electrical work
In regulation 7(b) of the Principal Regulations, for "a relevant asset operator" substitute "an asset operator or a network operator".
8Scheme description—asset operators and network operators
(1)In the heading to regulation 10 of the Principal Regulations, for "relevant asset operators" substitute "asset operators and network operators".
(2)In regulation 10(1) of the Principal Regulations, for "a relevant asset operator" substitute "an asset operator or a network operator".
9Formal safety assessment
(1)In the heading to regulation 11 of the Principal Regulations, after "Formal safety assessment" insert "—asset operators and employer operators".
(2)In regulation 11(1)(b) of the Principal Regulations, for "relevant asset operator's" substitute "asset operator's".
10New heading to Division 2 of Part 2 substituted
For the heading to Division 2 of Part 2 of the Principal Regulations substitute—
Division 2—Content of safety management system—asset operators" and employer operators".
11Safety management system
(1)In regulation 13 of the Principal Regulations, after "electricity safety management scheme" insert "for an asset operator or an employer operator".
(2)In regulation 13(b) of the Principal Regulations, for "relevant asset operator" substitute "asset operator".
12Safety policy
In regulation 14 of the Principal Regulations, after "system" insert "referred to in regulation 13".
13Standards for works on applicable assets—where there are published technical standards
In regulation 15 of the Principal Regulations, for "relevant asset operator" (wherever occurring) substitute "asset operator".
14Standards for works on applicable assets—where there are no published technical standards
In regulation 16(1) and (2)(b) of the Principal Regulations, for "relevant asset operator" substitute "asset operator".
15Applicable assets—asset management plan requirements
In regulation 18 of the Principal Regulations, for "a relevant asset operator" substitute "an asset operator".
16Access authority system
In regulation 20(1) of the Principal Regulations, for "a relevant asset operator" substitute "an asset operator".
17Emergency preparedness
(1)In regulation 21(2)(c) of the Principal Regulations, for "scheme operator" substitute "asset operator or employer operator (as the case requires)".
(2)In regulation 21(2)(d) of the Principal Regulations, for "a relevant asset operator" substitute "an asset operator".
(3)In regulation 21(2)(e) of the Principal Regulations, for "the means by which the operator" substitute "specify the means by which the employer operator".
18Internal monitoring, auditing and reviewing
In regulation 22(1) of the Principal Regulations, for "scheme operator" substitute "asset operator or the employer operator".
19Key performance indicators
In regulation 23(a) of the Principal Regulations, for "scheme operator's" substitute "asset operator's or the employer operator's".
20Incident recording, investigation and reviewing
In regulation 24(a)(i) of the Principal Regulations, for "a relevant asset operator's" substitute "an asset operator's".
21Competence and training
In regulation 25(1) of the Principal Regulations, for "a relevant asset operator" substitute "an asset operator".
22New Division 3 inserted into Part 2
After Division 2 of Part 2 of the Principal Regulations insert—
Division 3—Content of safety management system—network operators"
25ASafety management system—MEC
For the purpose of section 99(2)(b) of the Act, the electricity safety management scheme for a supply network of an MEC must specify a safety management system that complies with AS 5577.
25BSafety management system—other network operator
(1)This regulation applies to a network operator who submits an electricity safety management scheme under section 116 of the Act.
(2)For the purpose of section 116(2)(b) of the Act, the electricity safety management scheme must specify a safety management system that complies with AS 5577.".
23Requirements for reporting of serious electrical incidents
(1)In the heading to regulation 27 of the Principal Regulations, for "Relevant asset operator" substitute "Asset operator and network operator".
(2)In regulation 27 of the Principal Regulations, for "a relevant asset operator" (wherever occurring) substitute "an asset operator or a network operator".
(3)In regulation 27 of the Principal Regulations, for "the relevant asset operator" (wherever occurring) substitute "the asset operator or the network operator".
24Requirements for reporting of incidents other than serious electrical incidents
(1)In the heading to regulation 28 of the Principal Regulations, for "Relevant asset operator" substitute "Asset operator and network operator".
(2)In regulation 28(1) of the Principal Regulations, for "a relevant asset operator" substitute "an asset operator or a network operator".
