Road Safety Road Rules Amendment (Mobile Phones and Other Devices) Rules 2013

The Governor in Council makes the following Rules:

1Objective

The objective of these Rules is to amend the Road Safety Road Rules 2009—

(a)to clarify when a vehicle is parked for the purposes of rules regarding use of television receivers, visual display units and mobile phones; and

(b)to prohibit all probationary driver licence holders from using a mobile phone (including a hands-free device) while driving.

2Authorising provision

These Rules are made under section 95D of the Road Safety Act 1986.

3Commencement

These Rules come into operation on 25 November 2013.

4Television receivers and visual display units in motor vehicles

After rule 299(3) of the Road Safety Road Rules 2009[1] insert

"(4)For the purpose of this rule, a vehicle may be parked even though—

(a)the key to the vehicle is located in the vehicle's ignition lock; or

(b)the engine of the vehicle is running.".

5Use of mobile phones

(1)In rule 300(1) of the Road Safety Road Rules 2009 omit "P1".

(2)For the note at the foot of rule 300(1) of the Road Safety Road Rules 2009 substitute

"Note

Emergency vehicle, enforcement vehicle, learner driver, motor bike, park and police vehicle are defined in the dictionary.".

(3)In rule 300(1A) of the Road Safety Road Rules 2009 omit "P1".

(4)After rule 300(4) of the Road Safety Road Rules 2009 insert

"(5)For the purpose of this rule a vehicle may be parked even though—

(a)the key to the vehicle is located in the vehicle's ignition lock; or

(b)the engine of the vehicle is running.".
