Road Safety (Drivers) and (General) Amendment (Mobile Phones and Other Devices) Regulations 2013
The Governor in Council makes the following Regulations:

PART 1—PRELIMINARY
1Objectives
The objectives of these Regulations are—
(a)to amend the Road Safety (Drivers) Regulations 2009—
(i)to increase the demerit points that can be recorded against a person for an offence relating to the use of a mobile phone; and
(ii)to prescribe the demerit points that can be recorded against a person for an offence relating to the use of a television receiver or a visual display unit; and
(b)to amend the Road Safety (General) Regulations 2009 to increase the infringement penalty relating to the use of a mobile phone, television receiver or visual display unit.
2Authorising provision
These Regulations are made under section 95 of the Road Safety Act 1986.
3Commencement
These Regulations come into operation on 25 November 2013.

4Amendment of Schedule 3—demerit points
(1)After item 19 of Schedule 3 to the Road Safety (Drivers) Regulations 2009[1] insert—
"19A Drive motor vehicle with TV or visual display unit that is visible to driver or likely to distract another driver RR 299(1) 4". (2)In column 3 of item 20 of Schedule 3 to the Road Safety (Drivers) Regulations 2009, for "3" substitute "4".

5Amendment of Schedule 7—traffic infringements
(1)In column 5 of item 68 of Schedule 7 to the Road Safety (General) Regulations 2009[2], for "2" substitute "3".
(2)For item 69 of Schedule 7 to the Road Safety (General) Regulations 2009 substitute—
"69 2079 Learner driver or holder of a probationary driver licence using any mobile phone RR 300(1A) 3 penalty units". (3)In column 5 of item 164 of Schedule 7 to the Road Safety (General) Regulations 2009, for "2" substitute "3".
