Road Safety Road Rules Amendment (Heavy Vehicle National Law) Rules 2013
The Governor in Council makes the following Rules:

1Objective
The objective of these Rules is to amend the Road Safety Road Rules 2009 to give effect to the Heavy Vehicle National Law (Victoria).
2Authorising provision
These Rules are made under section 95D of the Road Safety Act 1986.
3Commencement
These Rules come into operation on the day on which section 4 of the Heavy Vehicle National Law Application Act 2013 comes into operation.
4Principal Rules
In these Rules, the Road Safety Road Rules 2009[1] are called the Principal Rules.
5Speed-limit where a speed-limit sign applies
For note 2 to rule 21(2) of the Principal Rules substitute—
"2If the vehicle is a class O vehicle as defined by the Road Safety (Vehicles) Regulations 2009, or a class 1 heavy vehicle, class 2 heavy vehicle or class 3 heavy vehicle as defined by the Heavy Vehicle National Law (Victoria), the vehicle may be restricted to a lower speed-limit by conditions imposed on a permit or notice applying to the vehicle.".
6Speed-limit elsewhere
For the note to rule 25(3) of the Principal Rules substitute—
"Note
If the vehicle is a class O vehicle as defined by the Road Safety (Vehicles) Regulations 2009, or a class 1 heavy vehicle, class 2 heavy vehicle or class 3 heavy vehicle as defined by the Heavy Vehicle National Law (Victoria), the vehicle may be restricted to a lower speed-limit by conditions imposed on a permit or notice applying to the vehicle.".
7No trucks signs
(1)In rule 104(5)(b)(ii) of the Principal Rules, after "Corporation" insert "or an authorised officer within the meaning of the Heavy Vehicle National Law (Victoria)".
(2)For rule 104(5)(c) of the Principal Rules substitute—
"(c)the driver has been issued—
(i)by the Corporation with a class O permit; or
(ii)by the Regulator with a mass or dimension exemption (permit) or a class 2 heavy vehicle authorisation (permit)—
authorising the vehicle to be on that road at that time.".
8Keeping a minimum distance between long vehicles
In rule 127(2) of the Principal Rules—
(a)in note 2 to the definition of long vehicle, after "2009" insert "or under the Heavy Vehicle National Law (Victoria)";
(b)in the definition of road train, after "2009" insert "or the Heavy Vehicle National Law (Victoria)".
9Stopping in a loading zone
In rule 179(1)(e)(ii) of the Principal Rules, after "Corporation" (wherever occurring) insert "or the Regulator".
10Making a motor vehicle secure
(1)In rule 213(7) of the Principal Rules, after "Corporation" insert "or the Regulator".
(2)In rule 213(8) of the Principal Rules, after "Corporation" (wherever occurring) insert "or the Regulator".
11Using lights when driving at night or in hazardous weather conditions
In rule 215(4) of the Principal Rules—
(a)after "Corporation" insert "or the Regulator";
(b)after "2009" insert "or the Heavy Vehicle National Law (Victoria)".
12Using lights on vehicles that are stopped
In rule 220(3) of the Principal Rules—
(a)after "Corporation" insert "or the Regulator";
(b)after "2009" insert "or the Heavy Vehicle National Law (Victoria)".
13How persons must travel in or on a motor vehicle
In rule 268(6) of the Principal Rules, after "Corporation" (wherever occurring) insert "or the Regulator".
14Driving with a person in a trailer
In rule 298(2)(d) of the Principal Rules, after "Corporation" insert "or the Regulator".
15Television receivers and visual display units in motor vehicles
In rule 299(2)(c) of the Principal Rules, after "Corporation" insert "or the Regulator".
16Exemption for oversize vehicles
In rule 311(1) of the Principal Rules, after "2009" insert "or section 5 of the Heavy Vehicle National Law (Victoria)".
17Dictionary
In the Dictionary to the Principal Rules—
(a)in paragraph (a) of the definition of authorised person, after "Corporation" insert "or the Regulator";
(b)in the definition of enforcement vehicle—
(i)at the end of paragraph (f) insert "or";
(ii)after paragraph (f) insert—
"(g)Heavy Vehicle National Law (Victoria);";
(c)in the definition of escort vehicle, after "2009" insert "or section 5 of the Heavy Vehicle National Law (Victoria)";
(d)in the definition of hazard warning lights, after "2009" insert "or the heavy vehicle standards under the Heavy Vehicle National Law (Victoria)";
(e)in the definition of mechanical signalling device, after "2009" insert "or the heavy vehicle standards under the Heavy Vehicle National Law (Victoria)";
(f)for the definition of oversize vehicle and the note at the foot of that definition substitute—
"oversize vehicle means a class O vehicle within the meaning of the Road Safety (Vehicles) Regulations 2009 or a class 1 heavy vehicle within the meaning of the Heavy Vehicle National Law (Victoria);
Note
Vehicle is defined in rule 15.".
18Statute law revision
In the Dictionary to the Principal Rules, in the definition of authorised person, in paragraph (b) for "Commission" substitute "Commission—".
