Water (Resource Management) Amendment Regulations 2013

The Governor in Council makes the following Regulations:

1Objective

The objective of these Regulations is to amend the Water (Resource Management) Regulations 2007 to provide for a reduced fee where specified applications are made by means of an automated lodgement process.

2Authorising provision

These Regulations are made under section 324 of the Water Act 1989.

3Principal Regulations

In these Regulations the Water (Resource Management) Regulations 2007[1] are called the Principal Regulations.

4Definitions

(1)In regulation 4 of the Principal Regulations insert the following definition—

"automated lodgement process means the process for enabling the making of an application through the Department's website for the purposes of regulations 10(a), 18(a) and 19(c)(i);".

(2)In regulation 4 of the Principal Regulations, in the definition of water allocation group application—

(a)before paragraph (a)(i) insert—

"(iaa)an application made under section 33AG of the Act; or"; and

(b)in paragraph (a)(ii), for "64K(3)(d)" substitute "64K(2)"; and

(c)after paragraph (a)(ii) insert—

"(iia)an application made under section 33AG of the Act and an application made under section 64K(2) of the Act; or"; and

(d)in paragraph (a)(iii), for "64K(3)(d)" substitute "64K(2)"; and

(e)after paragraph (a) insert—

"(ab)an application made under section 33AG of the Act together with an application made under section 64K(2) of the Act; or"; and

(f)in paragraph (b), for "64K(3)(d)" substitute "64K(2)".

5Regulation 10 substituted

For regulation 10 of the Principal Regulations substitute—

"10   Fee for application to give a water allocation assignment under Division 5 of Part 3A of the Act

The prescribed fee for an application made under section 33X(1)(c) of the Act is—

(a)3×20 fee units if the application is made through the automated lodgement process; or

(b)6×04 fee units if the application is made other than by way of the automated lodgement process.".

6Regulation 18 substituted

For regulation 18 of the Principal Regulations substitute—

"18   Fee for an application to use water on land

For the purposes of section 64K(3)(d) of the Act, the prescribed fee for an application to the Minister for approval to use water on land is—

(a)3×20 fee units if the application is made through the automated lodgement process; or

(b)6×04 fee units if the application is made other than by way of the automated lodgement process.".

7Group applications

For regulation 19(c) of the Principal Regulations substitute—

"(c)in the case of a person who makes a water allocation group application the prescribed fee is—

(i)3×20 fee units if the application is made through the automated lodgement process; or

(ii)6×04 fee units if the application is made other than by way of the automated lodgement process.".
