National Parks Amendment Regulations 2015
The Governor in Council makes the following Regulations:

1Objective
The objective of these Regulations is to amend the National Parks Regulations 2013 to—
(a)exempt the holder of a levee maintenance permit from particular offences while acting under and in accordance with that permit; and
(b)make minor and other miscellaneous amendments.
2Authorising provision
These Regulations are made under section 48 of the National Parks Act 1975.
3Commencement
These Regulations come into operation on
18 March 2015.
4Principal Regulations
In these Regulations, the National Parks Regulations 2013[1] are called the Principal Regulations.
5Interfering with rocks or similar natural objects prohibited
At the end of regulation 53 of the Principal Regulations insert—
"(2)A person does not commit an offence against subregulation (1) by engaging in an activity referred to in that subregulation under and in accordance with a levee maintenance permit issued under Part 5AA of the Water Act 1989.".
6Digging or removal of material prohibited
For regulation 55(2)(b) of the Principal Regulations substitute—
"(b)using a hand-operated bait pump to take bait for fishing in accordance with regulation 25(2); or
(c)engaging in an activity referred to in that subregulation under and in accordance with a levee maintenance permit issued under Part 5AA of the Water Act 1989.".
7Introduction of material prohibited
At the end of regulation 56 of the Principal Regulations insert—
"(2)A person does not commit an offence against subregulation (1) by engaging in an activity referred to in that subregulation under and in accordance with a levee maintenance permit issued under Part 5AA of the Water Act 1989.".
8Conditions of Minister's approval
(1)In regulation 126(d)(i) of the Principal Regulations, for "in Schedule 1" substitute "lodged in the Central Plan Office and numbered LEGL./14-006".
(2)In regulation 126(d)(ii) of the Principal Regulations, for "in Schedule 1" substitute "lodged in the Central Plan Office and numbered LEGL./14-006".
(3)In regulation 126(d)(iii) of the Principal Regulations, for "in Schedule 1, to the boundary of the Park" substitute "lodged in the Central Plan Office and numbered LEGL./14-006, to the boundary of the Park".
9Amendment to definition
In regulation 128 of the Principal Regulations, in the definition of Iron Prince and Gunshot Reefs area, for "in Schedule 2" substitute "on the plan lodged in the Central Plan Office and numbered LEGL./14-007".
10Revocation of Schedules
(1)Schedule 1 to the Principal Regulations is revoked.
(2)Schedule 2 to the Principal Regulations is revoked.
