Environment Protection (Scheduled Premises and Exemptions), (Industrial Waste Resource) and (Fees) Amendment Regulations 2015
The Governor in Council makes the following Regulations:

Part 1—Preliminary
1Objectives
The objectives of these Regulations are—
(a)to amend the Environment Protection (Scheduled Premises and Exemptions) Regulations 2007 to prescribe premises that store waste tyres as scheduled premises; and
(b)to make consequential amendments to the Environment Protection (Industrial Waste Resource) Regulations 2009; and
(c)to make consequential amendments to the Environment Protection (Fees) Regulations 2012.
2Authorising provision
These Regulations are made under section 71 of the Environment Protection Act 1970.
3Commencement
These Regulations come into operation on 29 April 2015.
Part 2—Amendment of the Environment Protection (Scheduled Premises and Exemptions) Regulations 2007
4Definitions
(1)In regulation 5 of the Environment Protection (Scheduled Premises and Exemptions) Regulations 2007[1], in the definition of volatile organic compound, for "carbonate salts." substitute "carbonate salts;".
(2)In regulation 5 of the Environment Protection (Scheduled Premises and Exemptions) Regulations 2007 insert the following definitions—
"EPU (equivalent passenger units), in relation to a type of tyre in column 1 of the Table in Schedule 3, means the corresponding value in column 2 of that Table;
wastetyres means whole rubber tyres which are considered waste for the purposes of the Act.".
5Regulation 16 substituted
For regulation 16 of the Environment Protection (Scheduled Premises and Exemptions) Regulations 2007 substitute—
"16 Transitional provision relating to premises used to store waste tyres
(1)Subject to subregulation (2), section 20(1) of the Act does not apply to an occupier of premises of a type numbered A09 in column 1 of the Table in Schedule 1 until 29 October 2015.
(2)If an occupier of premises who is exempted under subregulation (1) applies for a licence under section 20 of the Act before 30 October 2015, that section does not apply to the occupier until—
(a)the Authority issues a licence to the occupier; or
(b)the Authority refuses to issue a licence to the occupier.".
6Scheduled premises Table
In the Table in Schedule 1 to the Environment Protection (Scheduled Premises and Exemptions) Regulations 2007, after the row commencing "A08 (Waste to energy)" insert—

".
7New Schedule 3 inserted
After Schedule 2 to the Environment Protection (Scheduled Premises and Exemptions) Regulations 2007 insert—

In Schedule 1 to the Environment Protection (Industrial Waste Resource) Regulations 2009[2], after "Timber" insert "Tyres".
Part 4—Amendment of the Environment Protection (Fees) Regulations 2012
9Schedule 2—Base fee information
In the Table in Schedule 2 to the Environment Protection (Fees) Regulations 2012[3], after item 6 insert—
