Tobacco Amendment Regulations 2015

The Governor in Council makes the following Regulations:

1Objective

The objective of these Regulations is to make consequential amendments to the Tobacco Regulations 2007 as a result of the commencement of the Tobacco Amendment Act 2014.

2Authorising provision

These Regulations are made under section 43 of the Tobacco Act 1987.

3Principal Regulations

In these Regulations, the Tobacco Regulations 2007[1] are called the Principal Regulations.

4Regulation 11 substituted

For regulation 11 of the Principal Regulations substitute—

"11   Acknowledgement of consent

(1)For the purposes of section 36D(3) of the Act, the prescribed form of acknowledgement of consent by an occupier of premises to an entry and search of the premises and the seizure or taking of anything during the search is Form 1 in Schedule 4.

(2)For the purposes of section 36EA(5) of the Act, the prescribed form of acknowledgement of consent by an occupier of premises to an entry and inspection of the premises is Form 2 in Schedule 4.".

5Amendment to Schedule 4

(1)After the heading to Schedule 4 to the Principal Regulations insert—

"FORM 1".

(2)In Schedule 4 to the Principal Regulations for "Regulation 11" substitute "Regulation 11(1)".

(3)At the end of Schedule 4 to the Principal Regulations insert—

"FORM 2
