Supreme Court (Chapter I Judicial Review Amendment) Rules 2015

The Judges of the Supreme Court make the following Rules:

1Object

The object of these Rules is to amend Order 56 of Chapter I of the Rules of the Supreme Court to require that the plaintiff file an affidavit in support at the same time as an originating motion is filed under that Order.

2Authorising provisions

These Rules are made under section 25 of the Supreme Court Act 1986 and all other enabling powers.

3Commencement

These Rules come into operation on 1 July 2015.

4Judgment or order instead of writ

After Rule 56.01(4) of the Supreme Court (General Civil Procedure) Rules 2005[1] insert—

"(4.1)Without limiting paragraph (5), at the time of filing the originating motion the plaintiff shall file an affidavit setting out the acts, facts, matters and circumstances relied upon in support of the plaintiff's claim.".
