Road Safety Act 1986

Road Safety (General) Amendment (Lane Filtering) Regulations 2015

The Administrator of the State of Victoria as the Governor's deputy, with the advice of the Executive Council, makes the following Regulations:

1Objective

The objective of these Regulations is to amend the Road Safety (General) Regulations 2009 to—

(a)provide for an infringement offence and an infringement penalty relating to the new offence of unlawful lane filtering on a motor cycle; and

(b)make amendments of a statute law revision nature.

2Authorising provision

These Regulations are made under section 95 of the Road Safety Act 1986.

3Commencement

These Regulations come into operation on 2 November 2015.

4Amendment of Schedule 7—Traffic infringements

In Schedule 7 to the Road Safety (General) Regulations 2009[1], after item 53 insert—

"53A 8393 Lane filtering on a motor cycle in excess of 30 km per hour RR 151A 1 penalty unit".

5Statute Law Revisions

(1)In regulation 82(e) of the Road Safety (General) Regulations 2009, for "Department of Environment and Primary Industries" substitute "Department of Environment, Land, Water and Planning".

(2)In regulation 83(b) of the Road Safety (General) Regulations 2009, for "Department of Transport, Planning and Local Infrastructure" substitute "Department of Economic Development, Jobs, Transport and Resources".

(3)In regulation 85(l) of the Road Safety (General) Regulations 2009, for "Department of Environment and Primary Industries" substitute "Department of Environment, Land, Water and Planning".

(4)In regulation 85(n) of the Road Safety (General) Regulations 2009, for "an officer of the Marine Board of Victoria appointed under Part 8 of the Marine Act 1988" substitute "the Director, Transport Safety within the meaning of section 3 of the Transport Integration Act 2010".
