Mental Health Amendment Regulations 2015

The Governor in Council makes the following Regulations:

1Objective

The objective of these Regulations is to amend the Mental Health Regulations 2014 to prescribe the Independent Mental Health Advocacy service as a body in respect of which a direction to restrict an inpatient's right to communicate cannot be given under the Mental Health Act 2014.

2Authorising provision

These Regulations are made under section 370 of the Mental Health Act 2014.

3Commencement

These Regulations come into operation on 25 November 2015.

4New regulation 5A inserted

After regulation 5 of the Mental Health Regulations 2014[1] insert—

5ARestriction on right to communicate—prescribed persons and bodies"

For the purposes of section 16(2)(f) of the Act, the Independent Mental Health Advocacy service is a prescribed body.".
